1 INTRODUCTION
1.1 These Terms and Conditions regulate the sale, including registration, of MAUÎ Official products through the website www.mauiofficial.com.
1.2 The website www.mauiofficial.com is managed by Assunto Padrão, Unipessoal LDA., nº 514302313, Vila Nova de Famalicão, Braga.
1.3 For the purposes of these Terms and Conditions, the following definitions apply: a) – “MAUÎ Official” – The products marketed on the website www.mauiofficial.com; b) – “User” – Any individual, non-commercial customer who places an order through the website www.mauiofficial.com;
1.4 The use of the website www.mauiofficial.com and the purchase of MAUÎ Official products implies knowledge, understanding, and acceptance of these Terms and Conditions by the User.
2 REGISTRATION ON THE WEBSITE
2.1 To place an order, the User may register in advance by filling out the form available on the website www.mauiofficial.com. The User may also choose to place an order without prior registration.
2.2 From the moment the User accesses their personal account, they are bound by these Terms and Conditions.
3 MAUÎ PRODUCTS
3.1 The website www.mauiofficial.com is intended for all users who wish to purchase MAUÎ Official products from home or their workplace, 24 hours a day, 7 days a week.
3.2 Information about product characteristics can be consulted at www.mauiofficial.com.
3.3 MAUÎ Official reserves the right to modify, at any time, the information, product offerings, promotions, prices, and commercial conditions presented on the website www.mauiofficial.com.
4 PLACING ORDERS ON THE WEBSITE
4.1 To order on www.mauiofficial.com, the User must have an email account and their browser must be configured to accept cookies and pop-ups, allowing full functionality of the website www.mauiofficial.com.
4.1.1 The User may make online purchases of products, provided that they: a) Locate the product(s) they wish to purchase; b) Add the selected product(s) to the “Shopping Cart”; c) Register the User’s personal data, which will be included in MAUÎ’s database under the terms set out in the Privacy Policy, including “Delivery Address,” “Billing Address,” “Payment Method,” telephone number, and tax identification number (NIF); d) Review and confirm the order;
4.2 The User will receive an order confirmation email containing the details of the selected payment method.
4.3 The order will be delivered by the logistics operator to the delivery address provided during the purchase process.
4.4 By submitting the order form, the User accepts the Terms and Conditions of purchase described on www.mauiofficial.com, as well as the Privacy Policy.
4.5 MAUÎ Official reserves the right not to accept and/or cancel confirmed orders in the following situations: a) The product is unavailable; b) Payment was not made using one of the payment methods available on the website www.mauiofficial.com; c) Payment could not be confirmed; d) Billing information is incorrect; e) There was an error in the price quotation; f) Delivery cannot be made to the address provided by the User.
5 PRICES
5.1 The prices of the products displayed on www.mauiofficial.com include Value Added Tax (VAT). The total VAT payable by the User will be indicated on the invoice sent to the User.
5.2 All prices are quoted in euros (€). Please note that the change of delivery country may affect prices due to different transport costs. Customs duties related to the destination country will be borne by the customer.
5.3 Product prices shown on the website may change. MAUÎ Official reserves the right to change prices without prior notice. The prices displayed at the time of purchase are those applied to that transaction.
5.4 If there is an error in the price of ordered products, MAUÎ Official or the User may cancel the order prior to shipment.
5.5 The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.
5.6 The User must pay only the amount specified in the order confirmation.
5.7 All orders are processed in euros. If your bank account is in another currency, the exchange rate applied to your charge will be automatically determined by your Bank/Paypal and not by MAUÎ Official.
6 PAYMENT METHODS
6.1 The User may pay for their purchases using debit or credit card (Visa, Mastercard, American Express, Maestro, Union Pay), in 3 installments without interest (Klarna), MB Way, bank transfer, or Paypal.
6.2 MAUÎ Official does not accept any other payment method besides those mentioned above. The User should not attempt to pay using any means not specified among the accepted methods. If so, MAUÎ Official will not be responsible for payment loss or any related damages.
7 SHIPPING COSTS
7.1 Shipping to Portugal costs €6.
7.2 For destinations outside Europe, all orders will include a shipping cost and may incur customs duties depending on the destination country.
8 DELIVERY
8.1 MAUÎ Official ships the ordered product(s) from Monday to Friday, 9 a.m. to 6 p.m., except holidays, according to the logistics company’s schedule, to the delivery address indicated by the User.
8.2 Our delivery service does not include time scheduling.
8.3 Delivery times in Portugal and Spain range between 3 and 5 working days, depending on the ordered product. MAUÎ Official’s response time depends on stock availability, as well as on periods of promotions, sales, and holidays.
8.4 MAUÎ Official will inform the User of the unavailability of ordered products and refund the paid amount within a maximum of 15 (fifteen) days after confirmation of unavailability.
8.5 If the carrier cannot deliver on the scheduled date, the User will be contacted to agree on a new delivery date.
8.6 Upon delivery, the User must inspect the package for possible damages. If products appear damaged, the User must refuse the delivery. The User should report the issue, preferably with photos, to info@mauiofficial.com, and MAUÎ Official will resend the order at no cost to the User.
8.7 If the User does not receive their order within 90 (ninety) days from payment, please contact info@mauiofficial.com. After this period, MAUÎ Official cannot be held responsible for loss of the order.
8.8 Delivery is considered completed upon signature of the delivery receipt at the agreed address.
9 EXCHANGES AND RETURNS
9.1 The User has 90 days to request an exchange, provided that they contact info@mauiofficial.com before shipment.
9.2 MAUÎ Official does not offer direct exchanges. The User may opt for a voucher (valid for 18 months) to exchange their order for another product available on the website or exclusive item. The first exchange is free (except islands).
9.3 Customized products made to client specifications (tailored pieces, feature changes, color modifications, etc.) are not eligible for exchange.
9.4 If the ordered product is defective or non-compliant, the User must contact our team via info@mauiofficial.com, sending photographic evidence, so we can arrange a replacement.
9.5 MAUÎ Official does not issue refunds. Each piece is made to order to meet the client’s expectations. Once the order is placed, refunds are issued only as vouchers valid for 18 months.
9.6 By making a purchase, you agree to our exchange and return policy.
10 QUALITY
10.1 MAUÎ Official does not sell second-hand, defective, or substandard products. The main features of each product displayed on www.mauiofficial.com are described on its product page.
10.2 MAUÎ Official makes every effort to ensure that product colors displayed on www.mauiofficial.com are as accurate as possible. However, since computer screens vary, we cannot guarantee exact color representation.
11 COMPLAINTS
11.1 To continuously improve service quality, MAUÎ Official aims to address and resolve complaints submitted by the User within 5 (five) working days via info@mauiofficial.com.
12 WARRANTY AND AFTER-SALES SERVICE
12.1 MAUÎ Official products are covered by the conformity warranty provided under applicable consumer goods legislation.
13 EXCLUSION AND LIMITATION OF LIABILITY
13.1 MAUÎ Official does not guarantee uninterrupted operation of www.mauiofficial.com or its features, which may be suspended for maintenance, repair, or updates.
13.2 MAUÎ Official shall not be liable for damages arising, directly or indirectly, from force majeure events preventing compliance with obligations, such as strikes, power outages, telecom failures, fires, floods, inability to obtain materials, supplier delays, or legal changes.
13.3 MAUÎ Official is not responsible for misuse of User login data by third parties, as such data are personal and non-transferable.
14 MODIFICATION OF TERMS AND CONDITIONS
14.1 MAUÎ Official reserves the right to modify these Terms and Conditions at any time. Changes are deemed communicated upon publication of the updated Terms and Conditions on www.mauiofficial.com.
15 PROCESSING OF PERSONAL DATA
15.1 Please read our Privacy Policy carefully to understand the rules and procedures adopted by MAUÎ Official regarding data collected when browsing www.mauiofficial.com and using its features, as well as applicable security and confidentiality measures.
16 EVIDENCE AND RECORDS
16.1 Electronic records maintained securely by MAUÎ Official are considered evidence of communications, orders, and payments between MAUÎ Official and the User.
17 APPLICABLE LAW
17.1 These Terms and Conditions and any related disputes, including validity, website use, or purchases, shall be governed by Portuguese law.
