1.1 These Terms and Conditions govern the sale, including registration, of MAUÎ Official products through the website www.mauiofficial.com.
1.2The website www.mauiofficial.com is managed by the company Subject Padrão, Unipessoal LDA., nº 514302313, Vila Nova de Famalicão, Braga.
1.3 For the purposes of these Terms and Conditions, it is understood to: a) –“MAUÎ Official” – The products sold on the website www.mauiofficial.com; b) – “User” – any natural person, not a merchant, who places an order through the website www.mauiofficial.com;
1.4 The use of the website www.mauiofficial.com and the purchase of MAUÎ Official products presupposes knowledge, understanding and acceptance of these Terms and Conditions by the User.
2 REGISTRATION ON THE WEBSITE
2.1 To place an order, the User may register in advance, filling in the fields in the form on the website www.mauiofficial.com. You can also choose to place your order without prior registration.
2.2 From the moment you access your personal account, the User is subject to these Terms and Conditions.
3 THE PRODUCTS MAUÎ
3.1 The www.mauiofficial.com website is aimed at all users who wish to purchase MAUÎ Official products from their home or workplace, 24 hours a day, 7 days a week.
3.2 Information on product characteristics can be consulted at www.mauiofficial.com
3.3 MAUÎ Official reserves the right to modify, at any time, the information, product offer, promotions, prices and commercial conditions presented on the website www.mauiofficial.com
4 PLACE ORDERS ON THE WEBSITE
4.1 To order from www.mauiofficial.com, the User must have an email account and their browser must be configured to accept cookies and pop-ups, which in turn will allow them to enjoy all the navigability conditions of the website www. .mauiofficial.com.
4.2 The User will receive an order confirmation email with details regarding the payment method selected.
4.3 Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process.
4.5 MAUÎ Official reserves the right not to accept and/or cancel orders already confirmed in the following situations: a) The product is not available; b) Payment is not made using any of the payment options available on the website www.mauiofficial.com; c) Payment is not confirmed; d) Billing information is not correct; e) There is an error in the price quote; f) It is not possible to deliver to the address provided by the User.
5.1 The prices of products displayed on the website www.mauiofficial.com include Value Added (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the User.
5.2 Prices are all quoted in euros (€). Please note that changing the delivery country may affect prices due to different shipping costs. Customs costs relating to the country of delivery of the order will be borne by the customer.
5.3 The prices of the products shown on the website may change. MAUÎ Official reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
5.4 If an error is verified in the price of the requested products, MAUÎ Official or the User may, until the order is shipped, cancel the order.
5.5 The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.
5.6 The User must pay only the amount specified in the order confirmation.
5.7 All orders are processed in euros. If your bank account is in another currency, the exchange rate used to debit your account will be automatically determined by the Bank/Paypal and not by MAUÎ Official.
6 PAYMENT METHODS
6.1 The User can pay for his purchases with a debit or credit card (Visa, Mastercard, American Express, Maestro, Union Pay), in 3 interest-free installments (Klarna), bank transfer or Paypal.
6.2 MAUÎ Official does not accept any other payment method other than those mentioned in the previous point. The User must not attempt to pay by any means other than those specified in the specified payment methods. If you do, we cannot be held responsible for loss of payment or any other damages that may arise.
7 SHIPPING COSTS
7.1 Shipments to Portugal cost €5.
7.2 Outside Europe, all orders will have an associated shipping cost, which may require the payment of customs costs, depending on the country of delivery.
8.1 MAUÎ Official sends the product(s) ordered by the User, from Monday to Friday, from 9am to 6pm, with the exception of holidays, and on the days and times used by the logistics company, to the delivery address indicated by the User.
8.2 Our delivery service does not include a scheduling option.
8.3 Delivery times in Portugal and Spain vary between 2 - 10 working days depending on the item ordered. MAUÎ Official's ability to respond within the said deadlines varies depending on stock availability, as well as during periods of promotions, sales and Christmas.
8.4MAUÎ Official will inform the User of the unavailability of the product(s) ordered, as well as refund the amount paid, within a maximum period of 15 (fifteen) days from becoming aware of the unavailability.
8.5 In case of unavailability of the carrier to deliver the products on the indicated date, the User will be contacted in order to indicate another delivery date.
8.6 Upon delivery, the User must check the packaging for any damage. If you verify that the products are damaged, the User must not accept delivery of the order, which will be returned. The User must report the situation, if possible documented with photographs, via the email email@example.com and if he agrees, MAUÎ Official will resend the order, free of charge for the User. If the User wishes to cancel the order, the entire amount paid will be refunded.
8.7 If you do not receive your order within a maximum period of 90 (ninety) days from the date of payment of the order, please send an email to firstname.lastname@example.org informing us of what happened. After this period, MAUÎ Official cannot be held responsible for the loss of the order.
8.8 Delivery is considered carried out with the signature on the delivery receipt at the agreed address.
9 RIGHT OF FREE RESOLUTION
9.1 The User may terminate his contract up to 14 (fourteen) days after receiving the order, provided that: a) The product has not been used; b) The product keeps its original features and labels intact; c) The product is complete. All material accompanying the order must be returned.; d) The product has not been customized (tone change, custom-made, hemming arrangement, etc.)
9.2 The User can exercise his right of free termination by sending the Free Termination model or any other unequivocal declaration of termination of the contract, to the email email@example.com
9.3 The costs of returning the order in the exercise of the right of free resolution are borne by the customer.
9.4 Once the returned product has been received, MAUÎ Official will analyze and confirm the condition of the order and, when applicable, will refund, within a maximum period of 15 (fifteen) days, the amounts paid by the User in the order, through the same means used for payment of the order.
9.5 If the returned items show signs of use, MAUÎ Official reserves the right not to accept the return and to refuse refunds.
9.6 The User should note that, if the return has been made for reasons other than the justified existence of a defect or non-conformity of the ordered products, MAUÎ Official will not reimburse the shipping costs. Therefore, MAUÎ Official will not reimburse the expenses related to the postage initially borne by the customer for the respective order.

10 CANCELLATIONS AND REFUNDS
10.1 The User may cancel his order, provided he requests it via email email@example.com prior to shipment.
10.2 If the order has been received before shipment, we will refund the amounts paid by the User in the order, through the same means used to pay for the order, within a maximum period of 15 (fifteen) days.
10.3 If the order has been received after dispatch, the rules set out above, regarding the right of free withdrawal, will apply.
10.4 MAUÎ Official does not offer direct exchanges. The User may opt for a voucher to exchange his order for another item available on the website, being responsible for all costs related to the new shipment. Bear in mind that orders placed with a voucher and subsequently returned will only be able to receive a new voucher as a refund.
10.5 Returns of products made according to the consumer's specifications or clearly personalized (made-to-measure pieces, changes in characteristics, changes in tones or pieces produced by order/final product) are not accepted.
10.6 In the event that the ordered product is defective or otherwise non-compliant, the User may choose to: a) replace the product; b) resolve the contract.
10.7 As soon as the User discovers a defect or other non-compliance with the product, he must notify us via email at firstname.lastname@example.org, sending supporting photographs..
10.8 As soon as we receive your email, we will contact you to solve the problem consensually.
10.9 In any of the options exercised by the User, at the end of 10.6, the respective costs will always be borne by MAUÎ Official.
11.1 MAUÎ Official does not sell second-hand, defective or substandard products. The main features of each product shown on www.mauiofficial.com can be found on each product page.
11.2 MAUÎ Official will make every effort to ensure that the colors of the products that appear on the website www.mauiofficial.com are as accurate and real as possible. However, as computer monitors vary, we cannot guarantee that your monitor is showing the exact colors.
12.1 In view of the objective of continuous improvement of the services provided, MAUÎ Official will seek to respond to and resolve complaints submitted by the User within 5 (five) working days, via the email email@example.com
13 WARRANTY AND AFTER-SALES SERVICES
13.1 MAUÎ Official products benefit from the guarantee of conformity provided for in the legislation applicable to the sale of consumer goods.
14 EXCLUSION AND LIMITATION OF LIABILITY
14.1 MAUÎ Official does not guarantee the uninterrupted operation of the website www.mauiofficial.com, or any of its functionalities, which may be suspended for maintenance, repair or updates.
14.2 Likewise, MAUÎ Official will not assume any liability for any damages arising, directly or indirectly, from situations of force majeure that prevent MAUÎ Official, in any way, from fulfilling its obligations, namely, strikes, failures in the electrical network, telecommunications services or any other services, fires, floods, impossibility of obtaining products, materials or services, breakdowns, delays by suppliers or carriers and changes in legislation or administrative regulations.
14.3 MAUÎ Official is not responsible for any abusive use of the User's access data to the website by third parties, as they are personal and non-transferable.
15 MODIFICATION OF TERMS AND CONDITIONS
15.1 MAUÎ Official reserves the right to change these Terms and Conditions at any time, considering the changes made and users notified by publishing the modified Terms and Conditions on the website www.mauiofficial.com.

17.1 The computer records, kept by MAUÎ Official in safe conditions, are considered as proof of the communications, orders and payments made between MAUÎ Official and the User.

18.1 These Terms and Conditions and all emerging disputes that are related to them, including their validity, the use of the website or any purchase therein must be governed by Portuguese law.
